A Special Needs Trust is created to hold assets for the benefit of a person with a disability, who is the beneficiary of the Trust. This type of trust is structured specifically so that the beneficiary’s eligibility for government benefits, such as Medicaid or Supplemental Security Income, is not affected. The Trust is overseen by a Trustee, whose responsibility is to manage and administer the assets in the Trust for the beneficiary’s benefit.

The primary purpose of a Special Needs Trust is to supplement, not replace, government assistance. Funds from the Trust can be used to provide for the beneficiary’s care, education, recreation, and other expenses that are not covered by government programs. The Trustee ensures that the beneficiary can enjoy a better quality of life without losing access to essential government benefits.
